COMMENTS PERIOD FOR PROPOSED LOCAL RULE CHANGES

The Judges and Clerk’s Office, in conjunction with input from the Advisory Committee on Local Rules, Practice, and Procedures, is proposing modifications to SC LBR 5005-4, 5080-1, and 9036-1 for public comment. Brief summaries of the proposed modifications are as follows:

SC LBR 5005-4 (Electronic Filing): Proposed modifications regarding electronic filing by pro se parties using EDSS and eSR, including guidance on the timeframe for the Clerk’s Office to process the submissions and the deadline for filing documents concerning an upcoming hearing.

SC LBR 5080-1 (Fees): Proposed modification removing cash as a form of payment accepted by the Clerk’s Office for non-CM/ECF participants.

SC LBR 9036-1 (Notice by Electronic Transmission to Debtors): Proposed modification to the enrollment of a debtor in electronic noticing, requiring proof that the debtor’s address on the photo identification or other document presented to the Court corresponds with the address provided in the petition.

Comments to the proposed rules can be submitted to:scbml_lr_comment@scb.uscourts.gov (link sends e-mail), or by directly contacting Advisory Committee members listed below. Any comments should be sent by no later than August 6, 2025 and the current plan is to have them become effective on August 15, 2025.  A clean copy and a redline of the proposed rules are included here.

Rules are usually effective December 1 as part of the local rules review process. Should these proposed rules be finalized earlier, after consideration of any comments and edits received by the deadline set forth above, steps may be taken to make the proposed rules effective at an earlier date.
