New CM/ECF Events and Procedures

Several CM/ECF events have been activated and/or modified to assist filers and the Chapter 13 trustees.


1) Amended Notice for Relief Under 362 – the Court created a new event to be used if only an amended notice is needed for a motion for relief from stay or a motion to extend stay.  Filers are no longer required to file amended motions if there are errors only in the notice.  When filed, the amended notice must be linked in CM/ECF to the original motion to be added to the Court’s hearing calendar. 


2) Loan Modification Procedure – the Court updated its loan modification procedure as follows:
a. The “Loan Modification Documents” event was created for filing loan modification documents on the docket.  No further action is taken by the Court in response to this filing. A Participant’s Guide for this event is available. 
b. If the debtor would like the trustee to cease payments to the loan modification creditor, the debtor must file a “Request for Order Directing Ch 13 Trustee to Cease Payments.”  This event requires the debtor input the corresponding claim number according to the Court’s claim register and link the request to the Loan Modification Documents filed on the docket.  A Participant’s Guide for this event is available.  If the trustee consents to the Request, the Court will consider an order granting the Request.
c. The Court retired the “Notification of Permanent Loan Modification,” which is replaced by the “Request for Order Directing Ch 13 Trustee to Cease Payments.” 
d. The “Request for Order Authorizing Loss Mitigation” event remains, which allows parties to request the stay be lifted for them to participate in loss mitigation. 


3) Notice of Partial Satisfaction of Claim – this event and local forms for conduit and non-conduit cases may be used by creditors to advise the Chapter 13 trustee regarding the status of a claim.  The creditor will input the claim number according to the Court’s claim register and select whether the plan is conduit or non-conduit.  Upon filing, the Notice will appear on the docket and the claims register.  No further action is taken by the Court in response to this filing.


4) Notice and Motion to Dismiss or Convert at Confirmation Hearing if Documents Not Provided or Failure to Attend Meetings/Hearings – the title to the ECF event “Notice and Motion for Dismissal at Confirmation Hearing if Documents Not Provided or Failure to Attend Meetings/Hearings” was modified to incorporate conversion to chapter 7 as possible relief.
