Updates to the Hearing Notice (Application for Sale of Property Free and Clear of Liens) and Sale of Asset (Order) forms referenced in SC LBR 6004-1 have been published to the Court's Local Forms page and are effective for related applications and motions filed on or after October 25, 2022.  For Applications for Sale of Property Free and Clear of Liens, the applicant is required to disclose which subsection of 11 U.S.C. § 363(f) supports the sale free and clear.  The form order is for use with these Applications, as well as for Motions for Approval of a Sale (not free and clear), with additional/alternate language in the form order as indicated.
