Sincere congratulations and well wishes to our Clerk of Court, Tammi M. Hellwig, who has accepted a position as Director of Externships and Third-Year Program Administration at Washington and Lee University Law School in Lexington, Virginia beginning in January.  

After serving as a visiting professor for a semester, Tammi's husband, Brant, a professor of law at the University of South Carolina, has recently accepted an appointment as a Professor of Law at Washington and Lee Law, a top 30 law school. Tammi and their two children will be accompanying him to Virginia.
Tammi has done an outstanding job as Clerk of Court and will be greatly missed. Her tireless dedication to the Court, professionalism, skill and compassion cannot be replaced. We all wish her and her family great happiness in Virginia.

In addition to the legal holidays of Thursday, November 24, 2011; Monday, December 26, 2011 and Monday, January 2, 2012; the Court will follow the schedule being observed by the District Court and will be closed on Friday, November 25, 2011 (the day after Thanksgiving Day); Friday, December 23, 2011 (Friday before Christmas Day) and Friday, December 30, 2011 (Friday before New Year’s Day).

Chief Judge Waites is pleased to announce that David Jones has joined his chambers as a law clerk as of August 15, 2011. David is a 2011 honors graduate of Wake Forest University School of Law. David will be working in Judge Waites' Charleston office, while Judge Waites' other clerk, Sarah Kistler, will continue to work in the Columbia office.

Changes to Local Rule 3015-1, Exhibit A, and Exhibits A, B, C, D, and E to Local Rule 4003-2 have been made to reflect the Fourth Circuit's holding in Botkin v. DuPont Community Credit Union, C/A No. 10-1681 (4th Cir. Jun. 13, 2011). The Judges and Clerk wish to thank the Local Rules Committee for their review and comments to these rules.

The J. Bratton Davis United States Bankruptcy Courthouse will be closed on Thursday, August 4, 2011 in honor and memory of  United States District Judge Matthew Perry. Court business will resume on Friday, August 5, 2011.
The United States Trustee has advised the Court that the Meetings of Creditors (section 341 meetings) scheduled to be held in the Spartanburg Federal Courthouse on that date will be held as scheduled.

In light of the announced closing of the J. Bratton Davis United States Bankruptcy Courthouse on Thursday, August 4, 2011 and upon the report by Chapter 13 Trustee Keenan Stephenson that no matters originally scheduled for that date require immediate hearing, the Trustee has submitted early his recommendations for hearings on the consent docket. Upon instruction from Chief Judge Waites, the Court will record the Trustee recommendations on the docket of the applicable cases and the Judge will consider entering appropriate orders, including continuances of matters which require further hearings. Therefore, no hearings will be held on August 4, 2011.
Parties should refer to the case docket for information and address any questions to the Trustee or the Judge's chambers.

Chief Judge Waites and the staff of the U.S. Bankruptcy Court would also like to thank Kimberly Newton for her service as law clerk during the past year.  Kimberly has recently married and will return to the upstate of South Carolina to enter the private practice of law, including bankruptcy law. She has done an outstanding job and been a pleasure to work with. We wish her the very best!

Chief Judge Waites posts the following announcement of changes to his Guidelines to be effective with all matters presented to the Court in his cases as of August 15, 2011. These changes were among those posted for comment by the public and the bar earlier this year.

After receiving and considering comments from the Bar and the Trustees, changes have been made to Exhibit A to Local Rule 3015-1 and Local Rule 3070-1 to provide more timely distribution to debtor's counsel in chapter 13 cases. Exhibit A to Local Rule 3015-1 is also amended to clarify that a list of the specific names and addresses of parties served with the plan should be attached to the copy of the plan filed with the Court. Local Rule 1017-2 is amended to add paragraph (e), which governs the scheduling of motions to dismiss or convert a chapter 11 case. Local Rule 5073-1 and the Administrative Order on electronic devices are amended to conform with the Judicial Conference policy on wireless communication devices and also eliminate the registration of laptop computers by attorneys. The Judges and the Clerk wish to thank the Local Rules Committee for their work on these rule changes.
