The Judges would like to remind counsel that, according to Operating Order 07-12, a written fee agreement, in addition to the Rule 2016 Statement, is required to be filed with an application for supplemental fees. The application for supplemental fees should contain sufficient information to determine if the fee is fair and reasonable. A review of such applications has shown that many counsel are apparently relying on the 2016 Statement, which may not be sufficient under the Order.

In addition to the legal holidays of Thursday, November 27, 2008; Thursday, December 25, 2008 and Thursday, January 1, 2009; the Court will follow the schedule being observed by the District Court and will be closed on Friday, November 28, 2008 (the day after Thanksgiving Day); Friday, December 26, 2008 (the day after Christmas Day) and Friday, January 2, 2009 (the day after New Year’s Day).

The Judges of the Bankruptcy Court are pleased to welcome three new law clerks to the Court:


Marilyn E. Gartley joins Sarah Kistler as law clerks for Chief Judge Waites. Marilyn is a recent graduate of the USC School of Law.


Daniel D. Ray, law clerk for Judge Burris, and Harrison Penn, law clerk for Judge Duncan, are both recent graduates of the Charleston School of Law.


The Judges also wish to thank Jeff Davis, who has become Chief Deputy Clerk of Court, and Susan Sykes and Mac McClellion for their service as law clerks.


We wish them well in their new endeavors.

In compliance wtih the E-Government Act, Judicial Conference Policy, and Federal Rule of Bankruptcy Procedure 9037, a revised policy regarding electronic availability of transcripts of court proceedings has been implemented. Operating Order 08-04 contains the policy, which includes procedures for redaction, and supercedes the prior Operating Order 07-11. The Clerk's Office has also posted a revised Participant's Guide outlining procedural filing information.

Pursuant to Federal Rule of Bankruptcy Procedure 9037, certain privacy information must be redacted from filings made with the Court. It appears that many recent filings with the Court have not complied with Rule 9037, and the Court has been addressing requests and motions to correct these deficient filings more and more frequently. It is incumbent on the filer of any document to ensure that all privacy information is redacted, particularly with respect to notes, mortgages, security agreements and other attachments. As a result, the Court has added a section to the Chambers Guidelines to address redaction issues. The Open House held Friday at the Court was a great success with over 110 attendees from various parts of the state. The Judges, Clerk, and staff of the Court enjoyed the opportunity to greet members of the bar and staff as well as demonstrate features of the Court's new website and CM/ECF. Many thanks to the dedicated staff of the Clerk's Office that worked tirelessly to make the event a success.

Local Rule 9014-2 has been updated to clarify that a Trustee's or Debtor's Motion to Sell, Use, or Lease Property in a Chapter 11 case must be set for definite hearing.
