Effective March 2, 2009, all open Chapter 13 cases filed prior to January 1, 2008 in which William K. Stephenson, Jr. serves as trustee in the Columbia division were transferred from Judge John E. Waites to Judge Helen E. Burris. If you are an active e-filing party in any of these cases you will receive a Notice of Electronic Filing (NEF) for each case. Parties self-scheduling matters on or after March 2 should take care to schedule the matter before the assigned Judge.

Operating Order 07-12, Order Setting Procedures for Approval of Attorney's Fees in Chapter 13 Cases, has been amended as Operating Order 09-01 to reflect the changes to the chapter 13 form plan and the new numbering conventions set forth in the revised Local Rules.

In order to effectuate an equitable caseload division, Judge Burris will be assigned additional pending Chapter 13 cases in the Columbia division. Effective Monday, March 2, 2009, all open Chapter 13 cases filed prior to January 1, 2008 in which William K. Stephenson, Jr., serves as Trustee in the Columbia division will be transferred to Judge Burris. Previously scheduled hearings will be heard by Judge Waites or Judge Burris as appropriate. Parties self-scheduling matters on or after March 2 should take care to schedule the case before the assigned Judge.

Charleston Bar Evening Social
An informal social with the Charleston bar will be held on January 28, 2009 at 5:00 p.m. at the Roof Top - Vendue Inn. There will be an open forum discussion on any issues of interest to the bar, including suggestions for the Court. Chief Judge Waites, the Clerk and Chief Deputy plan to attend and look forward to seeing you there!

As previously announced, the U.S. Bankruptcy Court will partner with the South Carolina Bankruptcy Law Association to sponsor a paralegal and staff support seminar this Spring. The date for the seminar is tentatively scheduled for the morning and afternoon of Friday, March 13, 2009. In order to allow the Court to continue to provide an informative and useful seminar, please submit agenda topics as soon as possible to scbc_seminar@scb.uscourts.gov. In addition, any paralegals or staff willing to assist with the seminar, please respond to the same address. Details on registration and the program will be announced in the near future.

Following a period of comment, Operating Order 08-07, implementing the Guidelines for the Filing of Documents, has been entered providing a January 1, 2009 effective date. Since the original December 8, 2008 posting, the Court received comments and made additional clarification points to the signatory and retention sections contained within the Guidelines. A revised CM/ECF registration form will be posted on the Court’s website for new CM/ECF Participants. Existing Participants are deemed to have consented to and accepted the provisions of the Guidelines; therefore, a new registration form is not required.

Effective December 19, 2008, 11 U.S.C. 707(b)(2)(D) is amended as a result of the National Guard and Reservists Debt Relief Act of 2008. The new law provides for a temporary exclusion from means testing in chapter 7 cases for certain qualifying debtors in cases filed on or after December 19, 2008. Technical amendments have been made to Official Form B22A and the Judicial Conference has recommended that the Court adopt a model interim bankruptcy rule to effectuate the changes in the Bankruptcy Code. Pursuant to Operating Order 08-06, the Court adopts Interim Bankruptcy Rule 1007-I. The new rule incorporates the interim rule recommended by the Judicial Conference and adds subdivision (n)(1). The new subdivision clarifies that a debtor seeking to claim the exclusion should docket that the exclusion applies and, if the debtor is released from active duty during the pendency of the case, the debtor should also docket the release from active duty. Participant’s Guides have been created for these two new docket events in CM/ECF.
