Last year, the Judicial Conference approved an increase in the fee for filing a civil action under 28 U.S.C. Section 1914(a) from $150 to $250. The Bankruptcy Court Miscellaneous Fee Schedule, which sets forth the fee for filing an adversary proceeding, is linked to the civil action filing fee. However, at the time of the increase to the fee for filing a civil action, an increase to the adversary filing fee was held in abeyance. Effective September 20, 2005, the fee for filing an adversary proceeding in a bankruptcy case will increase to $250 as it continues to track the civil action filing fee.
