Redacting Confidential and Private Information

Fed. R. Bankr. P. 9037(a) requires parties to redact certain private information from documents filed with the Court. In recent months, the United States Trustee has found that a number of debtors have filed unredacted payment advices, which contain the debtor's full social security number, and follow the filing with a pleading to withdraw the unredacted filing on CM/ECF. A withdrawal of an unredacted document does not remove the document from CM/ECF. Parties who fail to redact must file a motion for a protective order pursuant to Fed. R. Bankr. P. 9037(d) if they wish to limit access to the document. Please refer to the Chambers Guidelines for further instructions on redaction and form proposed orders that may be used to limit access to an unredacted document.
