The following local rules are posted for comment. Changes to 3015-1, Exhibit A, and 3070-1 are proposed to provide for fair and improved distribution to debtor's counsel in chapter 13 cases. A technical amendment to Exhibit A is also proposed to clarify a debtor's obligation to attach to the plan a list of creditors served with the plan. Amendments are also proposed to 1017-2 to add paragraph (e), which governs the scheduling of motions to dismiss or convert a chapter 11 case, and to 5073-1 to conform with recommendations by the Judicial Conference. Comments should be submitted to scbc_lr_review@scb.uscourts.gov by no later than June 10, 2011. Changes to local rules 1017-2 and 3015-3 are proposed to provide for the dismissal or conversion of chapter 13 cases in which confirmation is denied. The change incorporates notice currently contained in the Notice of Meeting of Creditors. Notes are appended to each revised rule. These rule amendments are posted for comment. Comments should be submitted to scbc_lr_review@scb.uscourts.gov by no later than April 30, 2011. The Spartanburg Bankruptcy Court is closed today, Wednesday January 12. However, court scheduled for Thursday, January 13 in Spartanburg, SC will be held as scheduled. As a result of the icy road conditions, litigants and attorneys should use their best judgment to determine whether they can make it to the hearings safely. If you cannot attend due to weather, your hearing will be continued to January 27, 2011 at 10:00 a.m. at the same location. If you have any questions please call Barbara Miller at 803-765-5012 or contact your attorney if you are represented by counsel. If any matter is settled and you wish to advise the court and thereby avoid travel to Spartanburg, or if you wish to request a consensual continuance to a different date, please contact the court by phone as indicated or in the usual manner outlined in the chambers guidelines.

Judge Waites invites members of the Charleston Division Bar whose practice focus is in the consumer area to a meeting on Thursday, December 16, 2010 at 1:30 p.m. in the courtroom in Charleston to discuss ideas for improving the practice and areas of concern or interest to the bar and the court.

The Federal Rules of Bankruptcy Procedure will be amended on December 1, 2010. The amendments allow for a motion objecting to discharge, rather than an adversary proceeding, under certain circumstances; contain additional procedures for chapter 15 cases; extend the time for a debtor to complete financial management in a chapter 7 case; and shorten the time for a debtor to file a list of creditors after the order for relief in an involuntary case. A time computation change, inadvertantly omitted from Rule 4004 during the previous rule amendments, was also made. Technical and conforming amendments have also been made to the 341 Notice and the Means Testing forms. Further information about the national changes can be found on the Judiciary's website.

As a result of national changes, conforming time computation amendments have been made to Interim Rule 1007-I and Exhibit A to Local Rules 4001-4 and 9013-4. Exhibit A to Local Rule 9013-4 was also amended to allow a trustee to file a motion to retain assets. Finally, Local Rule 9070-1 is amended to reflect the process of pre-marking exhibits, which was announced to the bar on December 1, 2009. Notes are appended to each revised rule. These rule amendments are posted for comment. Comments should be submitted to scbc_lr_review@scb.uscourts.gov by no later than November 30, 2010. In the event a CM/ECF participant is unable to access CM/ECF, participants should refer to Operating Order 08-07, which allows for conventional paper filing under certain circumstances. Users unable to access CM/ECF may hand deliver or fax documents to the Court with a certification setting forth in detail the reasons the user did not file the documents electronically as stated in the Order. Documents not filed in accordance with Operating Order 08-07 may be stricken and the filing party may be subject to sanctions.
