Statement of Supplemental Chapter 13 Attorney Fees

New Statement of Supplemental Chapter 13 Attorney Fees event for all judges and amendment to relevant Local Rules.


The court has created a new event in CM/ECF: Statement of Supplemental Chapter 13 Attorney Fees located under the “Bankruptcy” and “Motions/Applications” menu. A participant's guide can be found here. The event simplifies the process for requesting supplemental fees, and in most instances, eliminates the need to file an amended Attorney Fee Disclosure Statement pursuant to Fed. R. Bankr. P. 2016(b) (Director’s Bankruptcy Form B2030). Conforming amendments to SC LBR 2016-1 and Exhibit A to SC LBR 9013-4 have also been made by Operating Order 20-11. The event may be used immediately and should be utilized for  supplemental fees requested on or after September 15, 2020. The Statement of Supplemental Chapter 13 Attorney Fees requires filing of a pdf indicating notice of the supplemental fee was given to the debtor and chapter 13 trustee. Note that in cases assigned to Judge Waites, the no look fee for LM/MM under the portal program is set in the Order Requiring LM/MM and is not a supplemental fee subject to further approval. Therefore, this fee should be indicated under “All previously approved no look LM/MM fees (portal only).” This no look LM/MM fee should also be included in the summary of the total fee amount in the case after fee has been ordered.
