After careful consideration of comments from the bar regarding conduit plan procedures and a joint recommendation from the Chapter 13 Trustees, and with the advice of retiring Judge David R. Duncan, Judges Burris and Gasparini have agreed to Operating Order 23-01 Conduit Mortgage Payments in Chapter 13 Cases. The Order is applicable to Chapter 13 cases in all divisions filed on or after June 10, 2023. Comments received regarding conduit plan procedures varied widely and the Judges endeavored to find an approach that is fair, equitable, and consistent in all divisions.
