New Federal Rule of Evidence 502

Based upon the recommendation of the Judicial Conference, Congress has amended the Federal Rules of Evidence by adding Rule 502. Under certain circumstances, the new rule limits a waiver of the attorney-client privilege and the work-product doctrine if the disclosure of privileged information is made in federal court or to a federal agency. The new rule is effective for all proceedings commenced on or after September 19, 2008 and for all pending proceedings, to the extent application is just and practicable.
