Future Assignment of Cases

Judge David R. Duncan was appointed as a judge of this Court on May 26, 2006. He has faithfully and tirelessly served since that time and will begin his well-deserved retirement at the end of May 2023. In anticipation of the need to transition from three to two judges, the judges have agreed on the future case assignments below. The judges and the Court will endeavor to avoid disruption resulting from this change as much as is practical, and appreciate your patience during this time of transition.


Beginning March 6, 2023:



  • Charleston Division – Gasparini is assigned all cases.

  • Greenville Division – Burris is assigned all cases.

  • Columbia Division:

    • Duncan – retain assigned cases filed before March 6, 2023.

    • Burris – assigned cases filed on or after March 6, 2023, from Aiken, Bamberg, Barnwell, Calhoun, Chester, Darlington, Dillon, Edgefield, Lancaster, Lee, Marion, or Richland Counties (this constitutes counties where Chapter 13 cases are assigned to Trustee Mathews).

    • Gasparini – assigned cases filed on or after March 6, 2023, from Chesterfield, Fairfield, Florence, Kershaw, Lexington, Marlboro, Newberry, Orangeburg, Saluda, or Sumter Counties (this constitutes counties where Chapter 13 cases are assigned to Trustee Simmons-Beasley).

    • Regardless of the judge assigned to a case in CM/ECF per the above list, Judge Duncan may preside over the Columbia Division hearings during this time. For Columbia Division cases, despite judge assignment, parties should follow Judge Duncan’s Judge Preferences for Chapter 13 cases until further notice. Ample notice will be given of any change in guidelines, preference or procedure.

On or about May 31, 2023:



  • Charleston Division – Gasparini is assigned all cases.

  • Greenville Division – Burris is assigned all cases.

  • Columbia Division:

    • Burris – all cases (new and reassigned) from Aiken, Bamberg, Barnwell, Calhoun, Chester, Darlington, Dillon, Edgefield, Lancaster, Lee, Marion, or Richland Counties (this constitutes counties where Chapter 13 cases are assigned to Trustee Mathews).

    • Gasparini – all cases (new and reassigned) from Chesterfield, Fairfield, Florence, Kershaw, Lexington, Marlboro, Newberry, Orangeburg, Saluda, or Sumter Counties (this constitutes counties where Chapter 13 cases are assigned to Trustee Simmons-Beasley).

Self-scheduling calendars have been drafted for June through September and, at the appropriate time, all three judges’ calendars for March through May will be updated to include the following or language to the effect of: "For hearings in the Columbia Division scheduled to occur in March, April, or May, select the appropriate location, date, and time slot based on the division, chapter, and hearing type, regardless of judge assignment."
